Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SMS Gateway Platform ("Platform"), including our website, API, web dashboard, and Android application. By creating an account or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Account Terms

You must be at least 18 years old to create an account and use the Platform.

You are responsible for maintaining the security of your account credentials, including your password and API tokens. You must not share your credentials with unauthorized parties.

You must provide accurate and complete information when registering. You are responsible for keeping your account information up to date.

You are responsible for all activity that occurs under your account, including actions taken by users you invite to your organization.

You must notify us immediately if you become aware of any unauthorized use of your account or any other security breach.

Acceptable Use

You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations, including:

No Spam: You must not use the Platform to send unsolicited bulk messages (spam). All recipients must have given prior consent to receive messages from you, in compliance with applicable anti-spam legislation.

Regulatory Compliance: You are responsible for complying with all local, national, and international telecommunications regulations applicable to SMS messaging in your jurisdiction. This includes obtaining necessary licenses or registrations for commercial SMS sending.

No Illegal Content: You must not use the Platform to send messages containing illegal content, including but not limited to threats, harassment, hate speech, or content that promotes illegal activities.

No Abuse: You must not attempt to circumvent rate limits, subscription quotas, or other platform controls. You must not use the Platform in a way that degrades service quality for other users.

Device Compliance: Android devices registered with the Platform must be devices you own or have authorization to use. You are responsible for any carrier charges incurred by SMS messages sent from your devices.

Service Availability

We strive to maintain high availability of the Platform, but we do not guarantee uninterrupted or error-free operation.

The Platform is provided on a "best effort" basis. SMS delivery depends on multiple factors outside our control, including mobile carrier networks, device connectivity, SIM card status, and recipient availability.

We reserve the right to perform scheduled maintenance, during which parts of the Platform may be temporarily unavailable. We will make reasonable efforts to provide advance notice of planned maintenance.

We are not responsible for SMS delivery failures caused by carrier network issues, device hardware failures, SIM card restrictions, or recipient phone settings.

You acknowledge that the Platform routes messages through your own Android devices and SIM cards, and delivery reliability is inherently dependent on your devices being online, charged, and connected to a cellular network.

Subscription and Billing

The Platform offers multiple subscription tiers with different feature sets and resource limits. Current plan details, pricing, and feature comparisons are available on our pricing page.

Free Trial: New accounts may be eligible for a free trial period (typically 7 days) with access to the Starter plan features. No credit card is required for the trial. At the end of the trial, you must select a paid plan to continue using the Platform.

Plan Limits: Each subscription plan includes specific limits on the number of devices, users, message volume, and available features. Exceeding your plan limits may result in service restrictions until you upgrade to a higher tier.

Billing Cycle: Paid subscriptions are billed either monthly or annually, as selected at the time of purchase. Annual subscriptions include a discount compared to monthly billing.

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, your account will remain active until the end of the current billing period. After that, your account will be downgraded and data retention policies will apply.

Refunds: We generally do not offer refunds for partial billing periods. If you believe you are entitled to a refund due to service issues, please contact our support team.

Intellectual Property

Platform Ownership: The Platform, including its source code, design, documentation, APIs, and all associated intellectual property, is owned by us and protected by applicable copyright and intellectual property laws.

Your Data: You retain full ownership of all data you upload, create, or transmit through the Platform, including message content, contact lists, and organization settings. We do not claim any ownership rights over your data.

License: We grant you a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms and your subscription plan. This license does not include the right to modify, distribute, or reverse-engineer the Platform.

API Usage: You may integrate with our API in accordance with the API documentation and your subscription plan. You must not use the API in a way that competes with or replicates the core functionality of the Platform.

Limitation of Liability

To the maximum extent permitted by applicable law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to lost profits, lost data, business interruption, or failure to deliver SMS messages.

We are not liable for damages resulting from SMS delivery failures caused by mobile carrier networks, device issues, SIM card restrictions, or factors outside our reasonable control.

Our total aggregate liability for any claims arising from or related to these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

These limitations apply regardless of the legal theory upon which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise.

Termination

We reserve the right to suspend or terminate your account if:

You violate these Terms, including the Acceptable Use policy.

Your account is used for fraudulent, illegal, or harmful activities.

You fail to pay applicable subscription fees after reasonable notice.

We are required to do so by law or regulatory order.

Upon termination, your right to use the Platform ceases immediately. We will retain your data for 30 days following termination to allow you to export your information. After 30 days, your organization database and all associated data will be permanently deleted in accordance with our privacy policy.

You may request immediate data deletion upon termination by contacting our support team.

Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or your use of the Platform shall be resolved through binding arbitration or in the competent courts of Romania.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
